Focus on the Family Applauds Bush’s Decision to Veto ENDA
President Bush will abide by his senior advisors’ counsel and veto ENDA should the proposed bill land on his desk. This move, commended by Focus on the Family, would help steer businesses away from costly unnecessary lawsuits.
Businesses are already prohibited from hiring, firing or making employment decisions based a person’s race, color, sex, national origin, religion, age or disability. With ENDA, Congress would add yet another category to this class: “actual or perceived sexual orientation.” Sexual orientation includes homosexuality, heterosexuality or “bisexuality.”
By creating a special federal protection for people’s “actual or perceived” sexual orientation, ENDA would create conflicting rights in the workplace. Employers are already required to protect their employees’ religious freedom in the workplace, and many religious faiths oppose the practice or endorsement of homosexuality. Thus, protecting religious freedom and “actual or perceived sexual orientation” makes for inevitable workplace litigation.
Not only would ENDA open the door for more litigation, but it may violate a business owners’ freedom of conscience. If a proprietor adheres to certain religious beliefs, ENDA would ban him from making employment decisions based on those cherished principles.
