NY School District’s Policy Affirms Pro-Life Expression

Attorneys for a New York State high school student who was censored by school officials in his attempts to communicate a pro-life viewpoint during the “Pro-Life Day of Silent Solidarity” say district officials have now agreed to a settlement in the lawsuit filed by the student.

The “Day of Silent Solidarity” is an annual student-led event giving participants an opportunity to warn classmates about the dangers of abortion. On the “Solidarity” day in Fall 2006, the principal of South Jefferson Clarke Senior High censored Scott Fish and several other students who were using T-shirts, armbands, leaflets, and “symbolic expression” to communicate their pro-life viewpoint, according to Fish’s legal counsel at Alliance Defense Fund. In January, the Jefferson Central School District agreed to permit use of pro-life clothing and leafleting outside of class as part of student free speech, following the filing of the lawsuit by Fish. The new settlement agreement codifies that policy, prohibiting only lewd, vulgar, indecent, profane, or sexually suggestive clothing.
